1. Acceptance of these Terms

These Terms and Conditions govern your access to and use of the BENARIAN website, content, enquiry services, affiliate links and any booking functionality made available from time to time. By using the website, you confirm that you have read, understood and agreed to these Terms. If you make a booking for another traveller, you confirm that you are authorised to accept these Terms on their behalf.

2. About BENARIAN

BENARIAN is a luxury travel and hospitality platform operated from Australia. We curate accommodation, dining, wellness and travel experiences and may introduce users to third-party travel suppliers and booking platforms. The exact role of BENARIAN may differ by product: in some cases we provide editorial or concierge assistance; in other cases we provide a tracked affiliate link or a technology interface supplied by an external partner.

3. Third-Party Suppliers and Booking Partners

Hotels, resorts, airlines, transport companies, restaurants, activity providers, payment processors and booking platforms are independent third parties. Their own terms, privacy policies, cancellation rules, house rules and eligibility requirements also apply.

• A booking is not confirmed until the relevant supplier or booking partner issues a valid confirmation.
• BENARIAN does not control a supplier's inventory, service delivery, staffing, maintenance, safety procedures or operational decisions.
• Where a booking is completed on a partner website, all payment, amendment, cancellation and refund requests must normally be handled through that partner.

4. Prices, Availability and Currency

Prices, availability, room types, inclusions and promotional offers may change at any time before a booking is confirmed. Search results may be personalised by travel dates, occupancy, currency, residence, device, membership status or partner conditions.

• The total price displayed at the final booking step should be reviewed carefully before payment.
• Taxes, resort fees, cleaning fees, service charges, security deposits and local government charges may be payable in addition to a headline rate where disclosed by the supplier.
• Currency conversions are estimates unless the booking partner states otherwise. Your bank or card provider may apply its own exchange rate and fees.
• BENARIAN does not guarantee that a displayed rate is the lowest rate available through every sales channel.

5. Booking Information and Traveller Responsibilities

You must provide complete and accurate names, dates, contact details, guest numbers and payment information. Traveller names should match passports or other required identity documents. You are responsible for checking the booking confirmation immediately and reporting any error to the relevant booking provider.

You are also responsible for meeting age restrictions, occupancy limits, check-in requirements, deposit rules and any property-specific conditions.

6. Cancellations, Changes, No-Shows and Refunds

Cancellation and amendment rules vary by supplier, rate plan and travel product. Some reservations are non-refundable or may incur a fee. Failure to arrive, late arrival, early departure or incomplete travel documentation may result in partial or total loss of the booking value.

• Refund timing depends on the supplier, booking platform, payment method and financial institution.
• BENARIAN cannot override a supplier's published cancellation policy.
• Any BENARIAN concierge assistance does not guarantee that a waiver, refund or amendment will be approved.

7. Fraud Prevention and Booking Verification

Verification may include requesting identification, confirming cardholder authority or referring the transaction to the relevant payment or booking provider. You must not use false information, stolen payment credentials, automated booking abuse or any method intended to avoid price, inventory or eligibility restrictions.

8. Passports, Visas, Health and Travel Requirements

You are solely responsible for checking current passport validity, visa, transit, vaccination, insurance, customs, entry and exit requirements with the relevant government authority, embassy, consulate or qualified adviser before travel.

BENARIAN is not responsible for denied boarding, refusal of entry, quarantine, deportation, fines or losses caused by incomplete or incorrect travel documentation.

9. Travel Risks and Insurance

Travel involves risks including delays, cancellations, illness, injury, weather disruption, natural events, industrial action, political conditions and supplier insolvency. You should obtain appropriate travel insurance covering medical treatment, cancellation, personal belongings, liability and the activities you intend to undertake.

10. Affiliate Relationships and Advertising

BENARIAN may earn a commission when you click a tracked link or complete an eligible booking with a partner. This normally does not increase the price you pay. Commercial relationships do not remove your responsibility to review the booking partner's final price and conditions. Sponsored or affiliate content will be identified where required. 11. Website Content and Intellectual Property

The BENARIAN name, branding, design, written content and original creative materials are protected by applicable intellectual property laws. Hotel names, images, trademarks, ratings and supplier information may belong to their respective owners and are used for identification, editorial, licensed or partner purposes.

You may use the website for personal, non-commercial travel planning only. You must not copy, scrape, republish, reverse engineer, misuse or commercially exploit website content without written permission.

12. Acceptable Use

You must not interfere with the website, attempt unauthorised access, introduce malicious code, impersonate another person, submit unlawful material, misuse promotional offers or use automated tools in a manner that burdens or damages the service. We may restrict or terminate access where misuse is suspected.

13. Website Availability and Accuracy

We aim to keep information accurate and the website available, but we do not guarantee uninterrupted access or that every description, photograph, amenity, rating, schedule or price is error-free or current. Supplier information may change after publication. Material errors may be corrected without notice.

14. Liability

To the maximum extent permitted by law, BENARIAN is not liable for acts, omissions, insolvency or service failures of independent suppliers, or for indirect, consequential or economic loss arising from use of the website or a third-party service. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

By following an external link, you may leave the BENARIAN website and enter a separately controlled service.
